    You can’t file your tax return until you receive your original w2 from your employer, employer has until Jan 31, 09 to either hand deliver the w2 to you or have them in the mail on Jan. 31, 2009 and banks usually issue the Form 1099INT by Feb 15, 2009/
    If you try to file with you without your w2 you will be filing an incorrect tax return, the amount from your last pay stub and your w2 will be different, and you could end up under reporting your income.

    If you worked for him last year, your W-2 from last year will show his EIN. If you have friends who worked for him last year, their W-2 from last year will have it. Or you can just ask him.
    However, you really need to have your W-2 to accurately complete your tax return. Your final paycheck is probably not correct–unless you stopped working for this employer earlier in 2008.

    To file your return you are legally required to have your w2 or use the subsitute if it is after 2/15 which is when the IRS considers your w2 late. The EIN you need will on the w2 when you receive it. Besides, the IRS isn’t even accepting efiles until 1/16 so you can’t file anyway

    W-2s are not required to be distributed until Jan 31. The Fed ID# will be on the W-2.

    Do not file your taxes until you get your W-2.
