What Percentage Of Income Can The Government Garnish To Collect Back Taxes?
My brother owes taxes from 14 years ago. He just got a job but now has a family to support. What percentage of his income can the federal government garnish to collect the back taxes he owes?
I also know that there is an order for which creditor gets paid first. CRA is somewhere around #10 on the list, and fmaily maintenance is ahead ( if he were owing any child support for example ).
There likely isn’t a % just as the previous poster said. It is based on what your income is, and what your expenses are and ability to pay.
Well, the IRS legally only has to leave him with 20% of his paycheck. The IRS will take into consideration his monthly expenses (call financials) and the number of dependents he has. However, if they put a levy on his wages, it would be because he has ignored the service, not just because he owes the debt.
i dont know what the percentage is but most likely after getting an idea of what is needed to pay bills;groceries etc… they’ll most likely take that.they know they cant take it all or eventually.he’ld have nothing. however they usually will work with ppl if they can make payments. its only when some one refuses to make an attempt that they garnish. if he makes payments they wont garnish. to garnish u gotta go thru legal stuff.and dont count on gettin a tax refund. theyll concider that a payment also
There will be a schedule that comes with the wage with holding order from the government to his employer, and he should be given a copy of the schedule. The government is always the first party on a wage garnishment order, they will unsurp all other creditors. I have seen up to 50% of a wage garnishment come through, but I have also seen 30 – 35% of their take home pay.
